Reforming Employment Act 1955

A coalition of 55 trade unions, worker organisations and NGOs have submitted proposals on Employment Act amendments to Ministry of Human Resources in January 2019.

We submitted 44 recommendations. The 7 key recommendations :

1) Same rights for all
2) 40 hour of work
3) 98 days maternity leave
4) No discrimination
5) Stop sexual harassment
6) End subcontracting activities
7) Migrant workers' right to redress.

Serah Memorandum Mengenai Akta Kerja kepada Ahli Parlimen

Hari ini, wakil 55 kesatuan sekerja, pertubuhan pekerja dan NGO menyerahkan memorandum mengenai pindaan Akta Kerja kepada Ahli-Ahli Parlimen parti pemerintah dan parti pembangkang.

Today, representatives of 55 trade unions, worker organisation and NGOs handed over memorandum on Employment Act amendments to Members of Parliament from ruling and opposition parties.

*Stop Piecemeal Reforms, Engage Stakeholders!*

The Decent Work Working Group (DWWG), represented by 55 trade unions and NGOs, expressed grave concern that the government has backtracked on several critically important labour law changes found in the Ministry of Human Resources’ (MOHR) initial draft Employment Act amendments in September 2018.

The DWWG has submitted series of proposals with justifications supported by international labour standards including other international standards acceded by the Malaysian government. The Ministry did not have any consultation with DWWG.

Consultation meeting on reforming Trade Union Act and Industrial Relations Act


In collaboration with Global Unions Federation (including IndustriALL), Decent Work Working Group organised the consultation meeting on reforming Trade Union Act 1959 and Industrial Relations Act 1967 on 13 January 2019.
We demand the government to remove various restrictions on registration of trade union, trade dispute, strike, recognition and collective bargaining.

Meeting on Industrial Appellate Court and Employment Act

Decent Work Working Group's initial discussion meeting on Industrial Appellate Court proposed by the Ministry of Human Resources. This is a preparation meeting for the larger consultation meeting on reforming Trade Union Act and Industrial Relations Act on 13 January 2019.


The Employment Act Working Committee meeting was also being held on the same day, which is a follow up discussion to finalise the feedback received after the Reforming Employment Act workshop on 9 December 2018 at Crystal Crown Hotel.

Apa itu Kerja Wajar?

Apa itu kerja wajar (decent work)?

Konsep kerja wajar diperkenalkan oleh Pertubuhan Buruh Antarabangsa (ILO) pada tahun 1999, tujuannya ialah melindungi hak pekerja dalam zaman globalisasi.

Menurut ILO, "dasar-dasar liberalisasi ekonomi telah menukarkan hubungan antara kerajaan, buruh dan perniagaan. Pengeluaran ekonomi sekarang lebih dipengaruhi oleh daya pasaran daripada pengantaraan pihak berkepentingan, norma-norma undang atau campur tangan kerajaan...menghasilkan risiko dan faedah yang tidak seimbang di antara kapital dan buruh...perubahan dalam corak pekerjaan, pasaran buruh dan perhubungan buruh mempunyai impak besar terutamanya terhadap kesatuan sekerja dan pertubuhan majikan."

"Globalisasi telah membawa kemakmuran dan ketidaksamarataan, ia menguji sempadan tanggungjawab sosial secara koletif."

Oleh itu, ILO telah menetapkan matlamat utama konsep wajar sebagai mempromosikan peluang untuk wanita dan lelaki untuk mendapat kerja yang wajar dan produktif, dengan prinsip-prinsip kebebasan, ekuiti, keselamatan dan maruah manusia.

4 objektif strategik kerja wajar ialah hak dalam pekerjaan, mempromosikan pekerjaan, perlindungan sosial dan dialog sosial.

Kerja wajar adalah penting untuk melindungi hak asasi manusia pekerja, seperti kebebasan berpersatuan, berunding dengan majikan secara koletif dan dilindungi oleh sistem kebajikan negara bila sakit, mengganggur atau menemui kemalangan.
